Although Hathaway was previously on the foundation`s board of directors, she is not being investigated.
Anne Hathaway's boyfriend's charitable foundation is being investigated by New York officials. Italian businessman Raffaello Follieri - who has been dating the actress for four years - is the head of the Follieri Foundation, whose work includes vaccinating children in the world's developing countries.
The probe is being headed up by New York Attorney General Andrew Cuomo, but his spokesman couldn't comment further about the ongoing investigation.
According to review records, the foundation has not filed IRS tax disclosure forms required from charities.
Although Hathaway was previously on the foundation's board of directors, she is not being investigated.
Her publicist Stephen Huvane said: "There is an investigation going on that does not involve Anne. She is no longer a board member of the Follieri Foundation. Other than that we will not be commenting."
This is not the first time Follieri has faced legal problems. Last year, he was sued for $55 million for allegedly using money from his company to spend on himself and the 'Devil Wears Prada' star.
In March, he paid out $1.3 million to his former investment partner, billionaire Ron Burkle, to settle the claims. Later that month, he was arrested for trying to pay a $250,000 bill to John Morrongiello with a bad cheque but later reimbursed the amount and didn't face charges.
He was also recently ordered by a Washington court to pay a public relations firm $250,000 for work done on his behalf.
