Bosnian Presidency Unimportant For Revision

The revision will not depend on acceptance from the Presidency of Bosnia, but only on new evidence.

The revision of the procedure of the International Court Of Justice in the Haag, because of Bosnia’s suit against Serbia and Montenegro for genocide, will not depend on the Presidency of Bosnia but exclusively on new evidence which the Bosnian team expects to gather in the following period.

The legal representation of Bosnia and Herzegovina explained that if it comes to new evidence which proves that Serbia committed or participated in genocide, he has the right, according to the International Court Of Justice to file a request for the revision of the process. He does not require permission or approval by the Presidency of Bosnia and Herzegovina.

Softic: Mandate until 2017

- The revision of the process is the only legal cure which knows the international legal order, and by this, the International Court Of Justice. Considering that the revision represents the continuation of the normal process, he does not require any approval or authority from the Presidency. Not even in the Bosnian legal lineup, does a lawyer require special approval to lodge an appeal or a request for the revision of a process – said Softic to the Dnevni Avaz daily.

He explained that he has that right because of the fact that he was named the legal agent of Bosnia and Herzegovina in this law suit, and therefore has the authority to represent Bosnia in the process before the court, which the revision of the process is. His jurisdictions end on the 26th February 2017, when the legal deadline for submitting a request for a revision ends.

Softic states that he can be stopped from filing the request for revision of the process only if the presidency brings the decision of his dismissal, or they name another person to be the agent.

The tribunal is not to blame, but the court

Softic, mentioned the letter of Geoffrey Nice, the chief prosecutor in the trial of Slobodan Milosevic, which accuses the chief Haag prosecution Carla del Ponte that she made an agreement with Belgrade about the protection of documents which confirm Serbia’s part in the war in Bosnia. He said that Bosnia and Herzegovina has been immeasurably harmed in the law suit in the International Court Of Justice.

- But this injustice can not be blamed on the tribunal, but the judges of the ICJ who did not even try to reach those documents – said Softic.
